To sign up for the SMS Service, you must provide a valid mobile phone number. By subscribing, you agree to receive recurring marketing text messages generated using automated technology.

If you need help, reply with the word “HELP” to 8336230629. If you wish to stop receiving messages, reply with “STOP,” “CANCEL,” “UNSUBSCRIBE,” “QUIT,” or “END” to the same number. After unsubscribing, you will receive a confirmation message, and no further messages will be sent unless you re-subscribe.

3. How to Unsubscribe or Update Your Information

To unsubscribe from the SMS Service, reply with “STOP,” “CANCEL,” or similar keywords to 8336230629. Upon unsubscribing, you will no longer receive messages unless you opt back in.

If you change your phone number, it is your responsibility to unsubscribe before the change to prevent messages from being sent to the new user of the number.

4. Data Privacy and Your Rights

Ervine’s values your privacy and complies with all applicable data protection laws, including the California Consumer Privacy Act (CCPA).

Under the CCPA and similar laws:

• You can request access to the data we have collected about you.
• You may request the deletion of your phone number or any other personal information. Once deleted, you will automatically be unsubscribed from the SMS Service.

5. Service Availability

Participating carriers include AT&T, Verizon, T-Mobile, and others. Some carriers or prepaid plans may not support the Service. Ervine’s cannot guarantee compatibility or performance for all users.

6. Age Restrictions

Participation in the SMS Service is limited to individuals who are 18 years or older. If requested, you may be required to provide proof of age to confirm eligibility.

7. Indemnification

By using the SMS Service, you agree to indemnify and hold harmless Ervine’s Auto Repair & Grand Rapids Hybrid and EV from any claims, liabilities, or damages arising from your participation. This includes providing an incorrect or invalid phone number or failing to unsubscribe before changing your number.

8. Disclaimers and Limitations of Liability

The SMS Service is provided “as is” without any guarantees of performance or availability. Ervine’s is not liable for failed, delayed, or misdirected text messages or any actions taken in reliance on the information provided through the Service.

9. Arbitration and Dispute Resolution

By using the SMS Service, you agree to resolve any disputes through binding arbitration, as outlined below:

• Arbitration will be conducted under the rules of the American Arbitration Association (AAA).
• Both parties waive their right to sue in court or seek a jury trial.
• Arbitration will not include class action claims.
• The losing party may be required to reimburse the other party for legal fees incurred during arbitration.

To initiate arbitration, you must serve written notice of your claim to the other party. Judgments rendered by the arbitrator may be entered in a court with appropriate jurisdiction.

10. Modifications to Terms and Conditions

Ervine’s reserves the right to modify or update these Terms and Conditions at any time. Updates will be effective immediately upon posting to our website. Continued use of the SMS Service constitutes acceptance of the revised Terms and Conditions.
